Chapter 236, Section 234: Knocking on That Familiar Door

The Wizengamo has exactly fifty members, including the chief wizard. New members can only join if someone steps down.

Dudley was lucky; after Dumbledore nominated him, "just so happened" that a Wizengamot member was found guilty of serious corruption and removed from his position, so Dudley was fortunate enough to become the replacement.
