There's a bug, Penello should only be in 4th grade when Harry's first grade, and she's not yet a Ravenclaw prefect at this time.

Each Hogwarts house selects a man and a woman to serve as prefects in the fifth year of the year and continue to hold that position in the sixth and seventh years. (Two in the fifth grade, two in the sixth grade, two in the seventh grade, after the seventh grader graduates, two more are selected from the fifth grade, and so on.)
